Consumer Report Disclosure and Authorization

DISCLOSURE TO CONSUMER

JIM BUTLER AUTO GROUP (the “Company”)

As part of our employment process, we may obtain one or more consumer reports or investigative consumer reports about you from a consumer reporting agency, such as:

These reports are obtained for employment purposes and may be obtained at any time after receipt of your authorization and, if you are hired by the Company, throughout your employment, to the extent permitted by applicable law.

Consumer reports may contain information bearing on your character, general reputation, personal characteristics, and/or mode of living. The types of information that may be obtained include, but are not limited to: employment history, academic and/or professional credentials, military service, credit history, driving history, vehicle safety inspection and performance history, public court records, personal reference checks, and criminal history.  

The information contained in the reports may be obtained from private and/or public record sources, including sources identified by you in your job application. An investigative consumer report may also include information obtained through interviews or correspondence with your past or present coworkers, neighbors, friends, associates, current or former employers, educational institutions, or other acquaintances. You have the right, upon written request, to a complete and accurate disclosure of the nature and scope of any investigative consumer report by submitting a request to the Company. 



AUTHORIZATION TO OBTAIN CONSUMER REPORT


JIM BUTLER AUTO GROUP (the “Company”)

By my signature below, I authorize the release of consumer reports and/or investigative consumer reports prepared by a consumer reporting agency to the “Company” and its designated representatives and agents for employment purposes. 

I acknowledge that I have received, read, and understood the separate documents entitled “Disclosure to Consumer” and “A Summary of Your Rights Under the Fair Credit Reporting Act.”

I understand that I have the right, upon written request, to be informed of whether a consumer report was requested.

I also understand that, to the extent allowed by law, information contained in my job application or otherwise disclosed to the Company by me may be utilized for the purpose of obtaining consumer reports.

By my signature below, I authorize law enforcement agencies, learning institutions (including public and private schools and universities), information service bureaus, government agencies, insurance companies, record/data repositories, courts (federal, state, and local), the Federal Motor Carrier Safety Administration, other motor vehicle records agencies, my past and present employers, the military, and other individuals and sources to furnish any and all information on me that is requested by the consumer reporting agency. 

Department of Transportation (“DOT”) Drivers. I understand that under Title 49 of the Federal Code of Regulations, Section 391.23, the Company may contact my former employers within the last three years. Information regarding my dates of employment, position, accident history, and drug and alcohol testing history may be requested from each employer in accordance with Sections 391.23 and 40.25.

By signing below, I consent to and authorize the gathering and release to the Company of this information by the Company’s designated representatives and agents, including any consumer reporting agency the Company has engaged, such as iiX, a Verisk Analytics Business. I understand and acknowledge that the information provided in the consumer reports or investigative consumer reports may assist the Company in making a determination regarding my suitability as an employee.

I agree that a copy of this authorization has the same effect as an original. I understand that if the Company hires me, my consent will apply and the Company may obtain such reports throughout my employment, to the extent permitted by applicable law.
